Welcome to Vintage Velvet. The terms “we,” “us” and “our” refer to Vintage Velvet, a sole proprietorship operated by Ahad Vadhariya.

Vintage Velvet operates this store and website, including its information, content, features, tools, products and services, to provide customers with a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with the policies referenced in them (collectively, the “Terms of Service” or “Terms”), describe your rights and responsibilities when using the Services.

Please read these Terms carefully, as they contain important information concerning orders, payments, delivery, intellectual property, warranty disclaimers and limitations of liability.

By visiting, interacting with or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you should not use or access the Services.

Nothing in these Terms is intended to exclude or restrict any rights or remedies available to consumers under applicable law.

Section 1 — Access and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority applicable in your jurisdiction. If you permit a minor dependent to use the Services through a device or account owned or managed by you, you are responsible for that use.

To browse our store, create an account or purchase products, you may be asked to provide information such as your name, email address, phone number, billing information, payment information and shipping address. You represent that the information you provide is correct, current and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign or license your account to another person.

Please notify us promptly if you believe your account or personal information has been accessed without authorization.

Section 2 — Our Products

We make reasonable efforts to describe and display our products accurately, including their colours, materials, dimensions, features and appearance.

However, colours and appearance may vary slightly because of screen settings, lighting conditions and device displays. Minor variations may also occur in handmade, embroidered, printed, natural-material or individually finished products. These reasonable variations do not affect any statutory rights available to you.

Product descriptions, availability and specifications may be updated without notice. We reserve the right to discontinue products or limit the quantity available to any person, household, geographic area or jurisdiction where reasonably necessary.

All purchases remain subject to availability and our applicable return, exchange and refund policies.

Section 3 — Orders

When you place an order, you are making an offer to purchase the selected products subject to these Terms and the policies referenced here.

An automated order acknowledgement does not necessarily mean that the order has been finally accepted. We may verify the order, customer information, payment, inventory and delivery details before accepting or dispatching it.

Prepaid orders are subject to successful payment authorization. Cash-on-delivery orders may be subject to OTP, phone-number or other order verification. We may hold or cancel an order that cannot be verified, contains materially incorrect information, appears fraudulent or presents a security risk.

We reserve the right to accept, decline, limit or cancel an order for legitimate reasons, including:

  • Product unavailability;

  • Payment failure or verification issues;

  • Incorrect pricing or product information;

  • Incorrect or incomplete customer details;

  • Suspected fraud, misuse or unauthorized resale;

  • Delivery restrictions; or

  • Circumstances outside our reasonable control.

If we cancel a prepaid order, the amount collected for the cancelled products will be refunded through the appropriate payment method within the applicable processing period.

Please review your order carefully before submitting it. Order changes or cancellations are possible only before the order enters processing or packing. Once an order has been processed or dispatched, it cannot be changed or cancelled.

Purchases, returns and exchanges are subject to our Refund Policy.

Unless separately agreed by us in writing, products purchased through the store are intended for personal, household or gifting purposes and not for unauthorized commercial resale or export.

Section 4 — Prices, Promotions and Billing

Prices, discounts, shipping charges and promotions may change without notice. The price applicable to an order will be the price displayed when the order is placed, subject to correction of genuine errors.

Unless expressly stated otherwise, prices displayed for orders within India include applicable product taxes. Any applicable shipping or handling charge will be displayed at checkout before the order is submitted.

International orders, where accepted, may be subject to additional shipping charges, customs duties, taxes or import charges imposed by the destination country. Unless expressly agreed otherwise, such charges are the customer’s responsibility.

Promotional offers may have separate eligibility requirements, validity periods, product restrictions and terms. If promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion.

Discount codes cannot be applied retrospectively after an order has been placed. An unused and valid discount code may be used on a future eligible order, subject to its terms.

You agree to provide accurate and complete purchase, payment and account information and to update it when necessary so that we can process transactions and communicate with you.

If you use a payment card or account, you represent that you are authorized to use it and that the information supplied is accurate. Payments are also subject to the terms, verification procedures and security controls of the relevant payment provider.

Section 5 — Shipping and Delivery

Orders are generally packed and dispatched within 1–2 working days. Dispatch and delivery estimates are not guaranteed and may be affected by order volumes, festivals, weather, courier disruptions, remote delivery locations or other circumstances outside our reasonable control.

Most domestic orders are delivered within the estimated period stated in our Shipping Policy. Tracking information will ordinarily be sent to the email address or mobile number provided at checkout after dispatch.

Customers are responsible for providing a complete and accurate delivery address and an accessible contact number. Additional charges may apply if a shipment must be sent again because of an incorrect or incomplete address, an unreachable recipient, refusal or repeated unsuccessful delivery attempts.

We remain responsible for addressing verified lost or damaged shipments in accordance with our Shipping Policy and applicable law. Risk in the product passes to you when the shipment is delivered to the address provided in the order.

Section 6 — Intellectual Property

The Services—including our trademarks, brand elements, logos, text, product descriptions, photographs, graphics, videos, audio, page designs and the selection and arrangement of content—are owned by or licensed to Vintage Velvet and are protected by applicable Indian intellectual-property laws and relevant international agreements.

You may access and use the Services for personal and non-commercial purposes. Unless expressly permitted by law or authorized by us in writing, you must not reproduce, distribute, modify, republish, commercially exploit, download, store or transmit our protected content.

Nothing in these Terms grants you any licence or ownership right in the intellectual property of Vintage Velvet, Shopify or any third party, except for the limited personal-use permission expressly stated here.

The Vintage Velvet name, logo, product names, designs and slogans are trademarks or brand assets of Vintage Velvet or their respective licensors and must not be used without prior written permission.

Shopify’s name, logos, product names, designs and slogans are trademarks of Shopify. Other names, logos and marks appearing through the Services belong to their respective owners.

Section 7 — Optional Tools

We may provide access to tools or functionality offered by third parties. We may not monitor or control these third-party tools.

Access to optional third-party tools is provided on an “as is” and “as available” basis, subject to applicable law and the terms of the relevant provider. Your use of such tools is at your discretion, and you should review the provider’s applicable terms and privacy practices.

We may introduce new features, tools or resources through the Services. Unless stated otherwise, those features will form part of the Services and will be subject to these Terms.

Section 8 — Third-Party Links

The Services may contain links to websites, applications or platforms operated by third parties.

We are not responsible for examining or guaranteeing the accuracy, availability, security or practices of third-party websites that we do not control. If you leave our Services to access a third-party platform, you do so subject to that platform’s terms and privacy practices.

We are not responsible for loss or damage caused solely by your independent purchase or use of third-party products, services or content that are not sold or provided by Vintage Velvet.

Questions or complaints relating exclusively to a third party’s products or services should be directed to that third party. This does not affect any responsibility that cannot lawfully be excluded.

Section 9 — Relationship With Shopify

Vintage Velvet is powered by Shopify, which enables us to provide the Services to you. However, sales and purchases made through our store are made directly between you and Vintage Velvet.

By using the Services, you acknowledge that Shopify is not the seller of products purchased from Vintage Velvet and is not responsible for the fulfilment of those purchases.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from the sale or fulfilment of products by Vintage Velvet. Nothing in this section limits any rights you may have directly against Shopify under applicable law or Shopify’s own services and policies.

Section 10 — Privacy Policy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Certain personal information may also be processed by Shopify in accordance with the Shopify Consumer Privacy Policy.

Because the Services are hosted by Shopify, information you submit may be transmitted to and processed by Shopify and relevant service providers, including providers located outside your country, as described in our Privacy Policy.

By using the Services, you acknowledge that you have had the opportunity to review these privacy policies.

Section 11 — Feedback and Reviews

If you voluntarily submit, upload, post, email or otherwise provide ideas, suggestions, feedback, reviews, photographs, proposals or other content relating to our products or Services (“Feedback”), you grant us a non-exclusive, worldwide, royalty-free and sublicensable licence to use, reproduce, adapt, publish, distribute and display that Feedback for operating, improving and promoting the Services.

This licence does not transfer ownership of your original Feedback to us.

You represent that:

  • You own the Feedback or have the necessary permission to provide it;

  • Your Feedback is accurate to the best of your knowledge;

  • You have disclosed any compensation or incentive connected with it; and

  • Your Feedback does not violate the law or the rights of another person.

We may moderate or remove Feedback that we reasonably consider unlawful, fraudulent, abusive, misleading, obscene, infringing or otherwise inappropriate.

You must not submit malicious software, use a false identity, misrepresent the origin of Feedback or post content that infringes another party’s copyright, trademark, privacy or other rights.

Section 12 — Errors, Inaccuracies and Omissions

Information available through the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping charges or delivery estimates.

We may correct genuine errors, update information or cancel affected orders when reasonably necessary. If we cancel a prepaid order because of an error, the amount collected for the cancelled products will be refunded.

Nothing in this section permits us to avoid obligations arising under applicable consumer law.

Section 13 — Prohibited Uses

You may access and use the Services only for lawful purposes.

You must not use the Services to:

  • Violate any applicable law or regulation;

  • Infringe our intellectual-property rights or the rights of another person;

  • Harass, abuse, threaten, defame or unlawfully harm another person;

  • Submit false, fraudulent or misleading information;

  • Transmit spam, unsolicited promotions or malicious code;

  • Impersonate another person or misrepresent your identity;

  • Collect or track another person’s personal information without authorization;

  • Interfere with the operation, security or accessibility of the Services;

  • Circumvent security, authorization, access-control or anti-fraud measures;

  • Scrape, copy, extract, reproduce, sell or exploit the Services or their content without authorization; or

  • Use automated systems in a manner that violates these Terms or applicable law.

We may suspend or terminate access when we reasonably determine that these Terms have been materially violated.

Section 14 — Automated Agents

This section applies if you deploy or permit software that takes autonomous or semi-autonomous action on your behalf (“Agent”) to access or interact with the Services.

An Agent must identify itself truthfully and must not conceal that the interaction is automated. It must not mimic human behaviour to evade controls, circumvent CAPTCHAs or bypass measures intended to identify, restrict or regulate automated access.

Agents must comply with technical requirements communicated through the Services, including applicable robot-exclusion instructions, access restrictions and reasonable identification requirements.

We may limit or prevent automated access when necessary to protect customers, inventory, pricing, security, infrastructure or the proper operation of the Services.

Section 15 — Suspension and Termination

We may suspend or terminate access to the Services if you materially breach these Terms, use the Services unlawfully, interfere with their operation or present a material fraud or security risk.

Termination does not affect payment obligations or rights that arose before termination.

Sections concerning intellectual property, Feedback, privacy, disclaimers, liability, indemnification, governing law and any provisions that by their nature should survive will continue to apply after termination.

Section 16 — Disclaimer of Warranties

Information presented through the Services is provided for general shopping and informational purposes. Although we take reasonable steps to maintain accurate information, we do not guarantee that all content will always be complete, uninterrupted or error-free.

To the fullest extent permitted by applicable law, Services that are not subject to an express product commitment are provided on an “as is” and “as available” basis.

We do not guarantee uninterrupted, timely or error-free access to the website, particularly where interruptions arise from maintenance, networks, third-party providers or circumstances outside our reasonable control.

Nothing in these Terms excludes:

  • Rights available under the Consumer Protection Act, 2019 or other applicable consumer law;

  • Obligations concerning defective, deficient, misdescribed or incorrectly supplied products; or

  • Any warranty, liability or remedy that cannot legally be excluded or restricted.

Section 17 — Limitation of Liability

To the fullest extent permitted by applicable law, Vintage Velvet and its proprietor, employees, contractors, service providers and licensors will not be liable for indirect, incidental, special, punitive or consequential loss arising solely from use of the Services where such loss was not reasonably foreseeable.

Nothing in these Terms excludes or limits liability for:

  • Fraud or fraudulent misrepresentation;

  • Wilful misconduct or gross negligence;

  • Death or personal injury where liability cannot legally be excluded;

  • Breach of a non-excludable statutory duty;

  • An accepted refund, replacement or other remedy under our published policies; or

  • Any consumer right or remedy that cannot be restricted under applicable law.

Shopify’s liability, if any, is governed by the terms applicable to Shopify and by applicable law.

Section 18 — Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Vintage Velvet, Shopify and their respective affiliates, personnel, contractors, licensors and service providers from third-party claims, losses or reasonable legal expenses arising directly from:

  • Your material breach of these Terms;

  • Your unlawful use of the Services;

  • Your infringement of another person’s rights; or

  • Fraudulent or malicious activity conducted through your account.

We will provide reasonable notice of an indemnifiable claim. You will not be responsible to the extent that a loss was caused by our own breach, negligence, wilful misconduct or violation of law.

Section 19 — Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.

Section 20 — Waiver and Entire Agreement

Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce it later.

These Terms and the policies incorporated by reference constitute the agreement governing your use of the Services and supersede prior versions concerning that use.

Nothing in this section limits representations, disclosures, statutory obligations or consumer rights that cannot lawfully be excluded.

Section 21 — Assignment

You may not transfer or assign your account or your rights and obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations as part of a lawful restructuring, sale or transfer of the business, subject to applicable law and without reducing your existing consumer rights.

Section 22 — Governing Law and Disputes

These Terms and any separate agreements through which we provide the Services are governed by the laws of India.

Subject to any mandatory rights or forums available under applicable law, courts having jurisdiction in Mumbai, Maharashtra will have jurisdiction over disputes arising from these Terms or the Services.

Nothing in these Terms prevents a consumer from approaching a competent Consumer Commission, regulatory authority or other forum available under the Consumer Protection Act, 2019 or other applicable law.

Before commencing formal proceedings, we encourage customers to contact our Grievance Officer so that we can attempt to resolve the matter promptly.

Section 23 — Headings

Section headings are included for convenience and do not limit or otherwise affect the interpretation of these Terms.

Section 24 — Changes to These Terms

The current version of these Terms can be reviewed on this page at any time.

We may update these Terms to reflect changes to our Services, business practices, policies or legal obligations. The revised version will be posted on this website with an updated date.

Where required by applicable law, we will provide additional notice of material changes. Continued use of the Services after an updated version takes effect constitutes acceptance of the revised Terms, subject to applicable law.
